Job Description
Job Summary:
The Legal Advisor & Defense Lawyer at Ghazanfar Bank will play a critical role in managing the bank's legal affairs, particularly in relation to loan collateral liquidation. This position requires a proactive approach to legal issues, ensuring the bank's rights are protected while maintaining compliance with applicable laws and regulations.
This role involves developing and implementing policies and procedures to enhance the bank's legal cases. The ideal candidate will possess a strong understanding of legal frameworks and practices, enabling them to effectively navigate and address the bank's legal challenges.
Job Description:
- Provide expert legal advice to Ghazanfar Bank regarding its rights, obligations, and legal options concerning loan collateral liquidation.
- Draft essential legal documents, including motions, appeals, and other filings to support the bank's claims in court.
- Follow up on non-performing loans that are referred to or pending with courts, judicial entities, and other relevant government bodies, and regularly report findings to the CEO and CCO/Dy CCO.
- Conduct thorough investigations and gather evidence to develop a robust defense strategy for court presentations related to collateral liquidation.
- Represent Ghazanfar Bank in court, effectively presenting arguments and evidence to defend the bank's position and protect its rights in property liquidation cases.
- Negotiate plea deals and settlements in court and with customers to achieve favorable outcomes for the bank.
- Maintain regular communication with both the bank and customers to keep all parties informed about ongoing cases and legal strategies.
- Stay informed about relevant laws and legal precedents that may impact defense strategies.
- Ensure the implementation of manuals and policies related to the legal and credit departments.
- Update and report on legal Management Information Systems (MIS) five days before the end of each month to the CEO, CCO, and other relevant Board of Management (BOM) members regarding legal cases related to collateral liquidations.
- Strictly follow up on cases classified as non-performing assets and issue consecutive legal notices in accordance with established legal policies and procedures.
- Follow up on and fulfill the requirements and procedures necessary for the completion of property mortgages (Bay-e-Jaizi) required as new and existing loan securities.
- Ensure the proper maintenance of mortgaged collateral securities (documents) after completing mortgage processes.
- Promptly release securities once the facility has been fully adjusted, following confirmation from relevant officials.
- Arrange official meetings as directed by relevant authorities to expedite legal processes.
Review legal title deeds (Sharayee Qabala) and related documents to ensure they are evaluated and attested to meet legal standards
Job Requirement
Qualifications
- Minimum of a Bachelor's degree in Sharia Law
- At least 2 years of professional experience in Legal Advisory, Non-criminal defense, or related legal fields
- Excellent verbal and written communication skills in Pashto, Dari, and English languages
- Licensed to practice law in Afghanistan
- Membership in the Afghanistan Independent Bar Association
