About AWEC: AWEC is a non-political, non-profit, woman-headed national organization established in 1991 by a group of educated Afghan women in exile, who rallied together to address the lack of facilities for Afghan refugees in Islamabad and eventually Peshawar, in Pakistan. AWEC has always been involved in advocacy and awareness-raising for women and children’s rights while providing services to those who frequently fall through safety nets. In recent years, one of AWEC’s core activities has been to support women through mobilizing Afghans, from local communities to political elites, towards the goal of reducing and eventually eliminating violence against women. Job Description
Position Objective
The job objective of Legal Consular/Lawyer/Adviser is to deal with all legal matter of beneficiary visiting AWEC’s Consultation Center under Amplify Change Project.
Project Background:
Amplify Change project being implemented in Herat provinceaims to support Afghan women and girls to participate more effectively in decision-making about their society by empowering them to access and use their legal rights, and by creating an enabling environment that facilitates their participation. It addresses two key issues that prevent women and girls from having greater participation in decision-making: high prevalence of gender-based violence, and weak capacity for coordination and joint advocacy among Afghan CSOs to protect and promote the rights and empowerment of women and girls. The project builds on the long-standing work of Oxfam and its partners to promote women’s rights in Afghanistan. It also includes input from Oxfam’s local CSO partners, the Afghan Women Network (AWN), provincial-level Department of Women’s Affairs (DOWA), provincial officials, and women and men leaders from project districts. Amplify Change integrates lessons learned from previous initiatives, including the need to develop holistic approaches to women and girl’s empowerment programming that integrate awareness-raising, leadership and modeling behavior—particularly among men, boys, religious and political leaders; access to justice, support services and economic opportunity for victims of violence; and increased CSO effectiveness on accountability, knowledge sharing, and advocacy for policy influence.AWEC is the implementing partner of AC project in Herat province and implements the project in three districts Enjil, Karokh and Gozara.
Duties & Responsibilities:
Setup legal consultation center in Herat province (Karokh District) within the premises of Directorate of Women’s compound based on the mapping and availability of VAW and GBV cases
Registering cases of violence against women meted out to women and girls visiting the center for legal consultation
Documentation of counselling records for each of the visitors in both soft and hard formats
Establishing database of cases recorded and updating the database from time to time and its submission to Field Coordinator for onward submission to AC Project Manager on frequent basis
Providing the visitors with legal consultation and referral services
Identify, setup and strengthen legal referral mechanism
Referral of cases of serious concern to advanced legal consultation centers or courts / attorney general office when and where required and necessary
Follow up and referral of cases of girls and women experiencing violence
Develop and maintain legal register and collect success stories on cases
Submission of weekly, monthly and quarterly reports to Field Coordinator for onward submission to AC Project Manager.
Advise clients concerning case, claim liability, advisability of prosecuting or defending lawsuits, or legal rights and obligations.
Interpret laws, rulings and regulations for clients
Analyze the probable outcomes of cases, using knowledge of legal precedents.
Present and summarize cases to judges and juries.
Gather evidence to formulate defense or to initiate legal actions, by such means as interviewing clients and witnesses to ascertain the facts of a case.
Represent clients in court or before government agencies.
Examine legal data to determine advisability of defending or prosecuting lawsuit.
Select jurors, argue motions, meet with judges and question witnesses during the course of a trial
Present evidence to defend clients or prosecute defendants in criminal or civil litigation.
Study Constitution, statutes, decisions, regulations, and ordinances of quasi-judicial bodies to determine ramifications for cases
Prepare and draft legal documents, such as wills, deeds, patent applications, mortgages, leases, and contracts.
Any other tasks being assigned by the Project Field Coordinator and AC Project Manager.
Job Requirement
Qualifications:
Bachelor Degree in Law or Sharia field
Obtain Legal license
Experience& Skills:
Should at least have 3 – 4 years of experience in legal and law-related activities and provision of legal advice to victims of violence against women and girls as well as referral of cases
Should have good proficiency in EVAW Law and other prevalent laws of the country, CEDAW convention and UNSCR 1325
Should have good communication skills
Should have good command of local languages
Knowledge of Dari, Pashto and English, written and spoken
Computer skill in MS. Office packages
Familiar with planning, and prioritizing tasks
Honest, active and well mannered
Strong Interpersonal & communication skills
