Job Description

Legal Advisor in Child Protection provides legal expertise and support to RRAA, governmental agencies, or NGOs involved in the protection of children’s rights and welfare. This role involves advising on legal matters related to child protection laws, child welfare, abuse investigations, and policy development, while ensuring compliance with national and international standards protecting children.

Key Responsibilities:

  1. Legal Counsel & Guidance:
    • Provide expert legal advice on issues related to child protection, including laws regarding child abuse, neglect, custody, adoption, foster care, and juvenile justice.
    • Advise child protection agencies, government bodies, or NGOs on legal risks, obligations, and strategies to safeguard children’s rights.
    • Guide teams on legal aspects of child welfare practices, ensuring that actions are lawful and prioritize the best interests of the child.
  2. Policy Development & Advocacy:
    • Assist in the development of child protection policies and protocols, ensuring compliance with national and international laws, including conventions such as the UN Convention on the Rights of the Child (CRC).
    • Advocate for legislative reforms or new policies to enhance the legal protections of children and improve child welfare systems.
    • Help organizations align their child protection strategies with evolving legal standards.
  3. Child Protection Legislation & Compliance:
    • Monitor changes in child protection laws, regulations, and international treaties, advising organizations on necessary adjustments to maintain compliance.
    • Ensure that child protection practices, reporting mechanisms, and intervention strategies adhere to relevant laws and ethical guidelines.
    • Guide the implementation of legal standards for child safety, privacy, and protection, including those related to data protection (e.g., child welfare records).
  4. Legal Representation & Advocacy:
    • Represent the organization or client in legal matters related to child protection, such as court cases, administrative hearings, or negotiations with government bodies.
    • Work with social workers, law enforcement, and legal teams to advocate for the rights and well-being of children in legal proceedings, including custody or abuse cases.
    • Provide support in complex cases, including child trafficking, sexual abuse, or international adoption cases.
  5. Case Review & Litigation Support:
    • Offer legal advice on child protection cases, helping organizations navigate legal proceedings or potential litigation related to child welfare.
    • Review case files and legal documents to ensure compliance with child protection laws.
    • Assist in preparing legal documentation and strategies for child protection hearings or investigations.
  6. Training & Education:
    • Provide training to staff and other stakeholders (e.g., social workers, law enforcement, educators) on legal requirements and best practices for child protection.
    • Educate organizations on the importance of maintaining legal documentation and records in child protection cases.
    • Lead workshops or seminars on child rights, legal frameworks, and effective legal responses to child protection issues.
  7. Collaboration with External Legal Authorities:
    • Liaise with governmental bodies, courts, law enforcement agencies, and other legal entities to ensure a coordinated response to child protection issues.
    • Assist in negotiations with external parties, including settlement discussions or collaboration on multi-agency child protection initiatives.
    • Support legal teams involved in child abuse investigations or cases of child exploitation.
  8. Research & Legal Advice:
    • Conduct in-depth legal research on emerging child protection laws, case law, and policies to ensure the organization remains up-to-date with current legal frameworks.
    • Provide legal opinions on sensitive issues, such as parental rights, child abuse reporting requirements, or international child protection laws.

Research best practices in child protection law across different jurisdictions and advise on their applicability.

Job Requirement

  • Education: Master of law. Specialization in family law, child protection law, or human rights law is preferred.
  • Experience: Proven experience in child protection law, family law, or working with children’s rights organizations. Experience in litigation, child welfare, or advocacy in the legal field is often required.
  • Skills:
    • In-depth knowledge of child protection laws, child rights, and relevant legal frameworks (e.g., UNCRC, local child protection statutes).
    • Strong legal research and analytical skills, with the ability to interpret complex laws and regulations.
    • Ability to advocate effectively for children’s rights in legal contexts and provide compassionate guidance.
    • Excellent written and oral communication skills, including drafting legal documents and reports.
    • Strong interpersonal skills for working with a multidisciplinary team, including social workers, law enforcement, and government officials.
