Job Description
Job Summary:
The deputy head of Legal Adviser is responsible for providing legal and legitimate advice to the Board of Executives, department staff and all departments of the bank within the orders of framework of law and regulations.
Providing legal advice to all the departments of Azizi Bank, in terms of loan documents, contracted and obtaining bank loans and other legal documents for the improvement and development of the bank with the advice and consultant of legal department head.
Tasks and Responsibilities:
- Arranging a monthly, quarterly and annual work plan in accordance with the work plan of the direct head and policy of the administration for legal board in advice of line manager.
- Following up legal document process During the stages of the documents form (Shari'a Deed of Sale), the persons who want the loan in the relevant departments and requesting the documents of the permissive sale deeds in the competent courts for the purpose taking the properties of the borrower under guarantee and instead bank loan personally or through legal advisors.
- Following up the legal cases of the loans guaranteed by the borrowers who have not fulfilled their obligations under the contracted agreements by the bank in specific time and requesting the verdict of the competent courts regarding taking of the decision in sale of properties under guaranteed personally or through legal advisors and its reporting to line manager.
- Pursuit and follow-up of crucial and final decisions of the courts (decision and sale licenses) in law offices in its implementation through the obligated Board referred to Article 45 of the Law on the obtaining of salary and following the directions of the departments about arranging beholden board referred Article 45 in relation to the sale of borrowers’ properties through volunteering and the benefit of obtaining bank loans and participating in the bidding meetings as an observer. Actually or through legal advisors.
- Execution and Termination of the documents of a permissive sale of deeds worthy of authority to the borrowers and property owners who have done a clearance to the bank in a definite time through the competent courts and the process of its documents in the relevant departments actually or through legal advisors.
- Providing legal advice (Legal Opinion) according to the rules and regulations applicable to all the department of Azizi Bank in case of need and reporting to line manager.
- Providing legal and legal advice to the credit departments of Azizi Bank in granting loans to individuals and providing technical explanations about the (legal) documents of the borrowers to be guaranteed.
- Pursuit and follow-up of the cases of the bank during the court, law offices, government cases, prosecutor's office, civil districts (municipalities) of Kabul, security police stations and other relevant departments in (Kabul and provinces) actually or through legal advisory and its reporting to line manager.
- Traveling outside of Kabul for arranging and preparing bank loan documents, following up on legal cases in justice and judicial departments for the purpose of obtaining bank loans, considering the guidance of competent bank officials. Actually or through legal advisors.
- Execution of any kind of official duty that is delegated by the direct head and the competent departments of the bank in accordance with the law and regulations.
- Providing legal advice in the implementation of documents or non-compliance to all the branches of Azizi Bank such as, Letters of Inheritance, Testament, Letter of Advocacy, etc. on the basis of documents and information provided. Actually or through legal advisors.
- Submitting weekly, monthly, quarterly and annual reports to the direct head and competent departments.
Smart Objectives/Key Performance Indicators (KPI):
- Leading the department employees, assigning them to their specified duties and controlling their working progress with the advice and consultant of legal dept., head.
- Providing Legal and canonical advice to legal advisory staffs and other departments of Azizi Bank within the scope of the law.
- Reviewing contracts on behalf of Azizi Bank with others to avoid the legal risks.
- Reporting to the line manager and performing other duties assigned by the head of department
- Tracking of the related government organizations regarding evacuation of properties under collateral of bank.
- Evacuation of the property under collateral of the bank and hand over of the same to the bank.
Job Requirement
Required qualifications and skills:
- Having a bachelor's or master's degree in law (law) or Sharia
- At least 5 years of working experience in legal position or debt collection or judicial and justice organs.
- Full mastery in Pashto and Dari, and fluency in English is preferred.
